These Terms of Service ("Terms") govern your access to and use of imottech.com and HFE Space (together, the "Service"), provided by IMOT (Shanghai) Technology Co., Ltd. (亿姆特（上海）科技有限公司, "IMOT," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You need an account to use HFE Space. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You're responsible for activity that happens under your account.
HFE Space Individual plans (Individual Free, Individual Plus, Individual Pro, and Individual Max) are single-user products: one credentialed account holder per account, with no shared credentials and no additional editor seats. If you need multiple people working on the same workspace with assigned roles, contact us to discuss a team or organization plan.
2. Subscriptions, Billing, and Points
HFE Space offers a free trial and several paid subscription plans, each with a monthly Points allowance, a project-slot limit, and storage limit as described on our Pricing page. Additional project slots and Points top-ups can be purchased separately.
- Individual Free: available once per person, for a limited time, with no payment method required. At expiry, your workspace becomes read-only until you subscribe.
- Billing cycles: paid plans bill monthly or annually, in advance, until cancelled.
- Upgrades take effect immediately.
- Downgrades and cancellations take effect at the end of your current billing period — you keep your existing entitlements until then, and we don't issue prorated refunds for the remainder of a period.
- Points cover AI-assisted operations (drafting, analysis, report generation); ordinary viewing and editing never consumes Points. Monthly Points reset each billing period and don't roll over. Points purchased as a top-up remain valid for 365 days from purchase.
- Refunds: monthly subscription charges and consumed Points are generally non-refundable except where required by law or in the case of a verified service failure. Annual subscriptions may be refunded within 7 days of initial purchase if no material use has occurred, consistent with our published refund practice at the time.
- Payment failure: if a renewal payment fails, your existing projects generally remain editable for a short grace period before the workspace becomes read-only, and access resumes once payment succeeds.
Prices are shown exclusive of any sales tax, VAT, or similar tax unless stated otherwise; applicable tax is calculated by our payment provider based on your location.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or in a way that infringes someone else's rights.
- Share your account credentials, or circumvent plan limits (project slots, Points, or the single-user restriction) through automation or account sharing.
- Attempt to reverse-engineer, probe, or disrupt the Service, or interfere with other users' access to it.
- Upload content you don't have the right to submit, or content containing another person's confidential or regulated data without authorization.
We may suspend or terminate accounts that violate these Terms.
4. Your Content
You retain ownership of the project information, files, and content you submit to HFE Space ("Your Content"). You grant IMOT a limited license to store, process, and display Your Content solely to provide and improve the Service to you — including sending relevant portions of it to AI processing providers to generate drafts, as described in our Privacy Policy. We don't use Your Content to train third-party AI models, and we don't sell it.
The Service itself — its software, design, and HFE Space methodology — is owned by IMOT and protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks, branding, or underlying platform beyond what's needed to use the Service as intended.
5. AI-Generated Content Is a Draft, Not a Deliverable
HFE Space's AI-assisted features draft use scenarios, risk statements, report sections, and similar content based on the information you provide. This output is a starting point, not a finished or validated work product. It has not been reviewed for accuracy, completeness, or regulatory acceptability, and must be reviewed, edited, and approved by a qualified human factors engineer before it's relied upon for any regulatory submission or real-world decision. IMOT makes no warranty that AI-generated content is accurate, complete, or sufficient for any regulatory purpose, and you are solely responsible for verifying and validating any output before use.
6. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or fully secure.
To the maximum extent permitted by law, IMOT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
7. Termination
You may cancel your subscription at any time from your account; cancellation takes effect at the end of your current billing period as described in Section 2. We may suspend or terminate your access if you materially breach these Terms, or as needed to protect the Service or other users. In either case, your data remains subject to the retention and export rights described in our Privacy Policy — we don't delete controlled records simply because a subscription ends.
8. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify account holders directly. Continuing to use the Service after changes take effect means you accept the updated Terms.
9. Governing Law
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles, unless applicable local law requires otherwise.
